
The Advisory Committee of the Energy Community resumes its work
The Ministerial Council in its last meeting in December 2024 has appointed the members of the Advisory Committee of the Energy Community: Prof. Dr. Rajko Pirnat and Prof. Dr. Verica Trstenjak have been re-appointed and Ms Olena Kuchynska, LL.M., Prof. Dr. Alina-Maria Lengauer, LL.M. and Mag. Alexandra Schwaiger-Faber have been appointed as members for a term of four years. As a first step, the Advisory Committee has elected Prof. Pirnat as its President and Mag. Schwaiger-Faber as its Vice-President.
Following the formal establishment, the Advisory Committee is ready to resume its work under the Energy Community Dispute Settlement Rules.
The Advisory Committee is a body of independent legal experts with an advisory function to the Ministerial Council in the dispute settlement process. The Opinions of the Advisory Committee are an integral part of the dispute settlement procedure.
Before the Ministerial Council may determine the existence of a breach by a Party of its obligations under the Energy Community Treaty, the current Presidency and Vice-Presidency are required to ask the Advisory Committee for its Opinion on the case at hand.
